What’s the Difference Between a Bail Bondsman and Posting Cash Bail in San Diego?

What's the difference between a bail bondsman and posting cash bail in San Diego?

When bail gets set at $75,000, most families immediately start asking the same question: do we pay the full amount, or do we use a bondsman?

Both paths get someone out of custody. But they work very differently, cost different amounts, and carry different risks. Here’s what you need to know before you decide.

How Cash Bail Works in San Diego

Cash bail means you pay the full bail amount directly to the court. This can be done in actual cash, by cashier’s check, or sometimes by credit card, depending on the facility.

When the case concludes, assuming the defendant appeared at all required court dates, the bail is returned. The court keeps a small administrative fee, but the bulk of what you paid comes back.

Key facts about cash bail:

  • You pay 100 percent of the bail amount upfront
  • The money is tied up for the duration of the case, which can be a year or more for felonies
  • If the defendant fails to appear, the bail is forfeited and you lose the entire amount
  • At the end of the case, you get most of it back regardless of the verdict

How a Bail Bond Works in San Diego

A bail bondsman acts as a surety. You pay them a premium, and they post the full bail amount on behalf of the defendant.

In California, bail bond premiums are regulated by the California Department of Insurance under California Insurance Code Section 2099. The standard rate is 10 percent of the total bail.

On a $75,000 bail, that’s $7,500. This premium is non-refundable — you don’t get it back at the end of the case, regardless of outcome or how quickly the case resolves.

In exchange, the bondsman is responsible to the court for the full bail amount if the defendant doesn’t appear.

To protect themselves, bondsmen often:

  • Require collateral (property, vehicles, or co-signers)
  • Add conditions to the bond, such as check-in requirements
  • Have the legal authority to locate and return the defendant if they fail to appear

Comparing the Two Options Side by Side

Factor Cash Bail Bail Bond
Upfront cost 100% of bail 10% of bail (non-refundable)
Money returned at case end? Yes, mostly No
Collateral required? No Often yes
Risk if defendant misses court Lose full amount Bondsman pursues recovery
Processing speed Depends on facility Often faster

Which Option Makes More Sense?

There’s no universal answer, but here are the practical considerations:

Cash bail makes more sense when:

  • You have liquid funds available and don’t want to pay a non-refundable premium
  • The case is expected to resolve quickly, so the money isn’t tied up long
  • The total bail is low enough that the 10 percent fee isn’t a meaningful savings

A bail bond makes more sense when:

  • You don’t have the full bail amount available in liquid form
  • You’d rather pay a guaranteed non-refundable 10 percent than risk tying up a much larger amount indefinitely
  • The case involves high bail where liquid access to the full amount isn’t realistic

What About Payment Plans from Bondsmen?

Many San Diego bail bond companies offer financing arrangements, allowing families to pay the 10 percent premium over time. These arrangements typically require a co-signer and may involve additional costs depending on the terms.

Read the agreement carefully before signing. The California Department of Insurance licenses and regulates bondsmen, and any licensee should be verifiable through their online license lookup.

What Your Attorney’s Role Is Here

A criminal defense attorney doesn’t post bail, but they can be valuable at this stage.

Attorneys can:

  • Bring a bail reduction motion to lower the bail amount before any money changes hands
  • Advise on whether certain conditions attached to a bond could create problems later
  • Help you understand whether the current bail amount is worth challenging
  • Whether posting bail before the arraignment even makes sense

Getting bail reduced from $75,000 to $40,000 is worth far more than shopping for a better premium rate. That’s the leverage worth pursuing first.
